GCB Communictions Inc. v. US South Communications Inc., 09-17646
In a dispute involving the interpration of several FCC orders and arising from a dispute regarding which party bears the expense when a completing payphone carrier does not receive an Flex-ANI coding number, 47 C.F.R. section 64.1300, judgment of the district court in favor of the plaintiff is reversed where failure to refer dispute to the FCC on primary jurisdiction grounds was not an abuse of discretion and the district court erred in its interpretation of the relevant FCC directives.
