Appeal of defendant’s 46 month sentence for possessing heroin with intent to distribute is dismissed pursuant to her appeal waiver where the government's failure to object to the district court’s imposition of a two-level downward departure under U.S. Sentencing Guidelines section 5K3.1, instead of a four-level downward departure specified in the plea agreement, was not a breach of the plea agreement.
