Valencia v. Lynch, 13-70414

In an immigration action, the denial of petitioner's application for adjustment of status is affirmed where the Attorney General's regulation 8 C.F.R. section 1245.10(j), preventing an alien substituted for a previous beneficiary of a labor certification from grandfathering in under 8 U.S.C. section 1255(i)(1)(B)(ii), is valid as a reasonable interpretation of an ambiguous statute and entitled to Chevron deference.
