Meyer v. Portfolio Recovery Associates, LLC, 11-56600

In plaintiff's suit alleging that defendant's debt collection practices violated the Telephone Consumer Protection Act, district court's order granting plaintiff's motion for a preliminary injunction and provisional class certification is affirmed where: 1) the district court acted within its discretion when it ruled that plaintiff met the commonality, typicality, and adequacy requirements of FRCP 23(a), and did not abuse its discretion by granting provisional class certification; and 2) plaintiff has demonstrated that irreparable harm is likely in the absence of injunctive relief.
