United States Ninth Circuit

US v. Orozco, 13-30199

Defendant's convictions for manufacturing marijuana plants and carrying a firearm during a drug trafficking crime are affirmed, where: 1) the district court did not abuse its discretion in denying a mistrial on the basis of testimony that the defendant was advised of his right to consulate, as the reference did not convey anything about defendant's legal status in the United States; and 2) the district did not abuse its discretion in refusing to reopen evidence to allow the defendant to testify, as the defendant must invoke the right to testify before the close of evidence.
