United States Third Circuit
US v. Ottaviano, 11-4553
Defendant's convictions for for mail and wire fraud, money laundering, tax evasion, and conspiracy to defraud the Internal Revenue Service are affirmed, where: 1) the district court erred in questioning defendant but there was such overwhelming evidence of defendant's guilt that the district court's improper questioning was immaterial to the jury's verdict; and 2) defendant's Sixth Amendment right to represent himself was not infringed when the district judge ordered him to leave the courtroom during the discussion about his letter to the Treasury Secretary, because even if it was error, it was harmless.
