US v. Kluger, 12-2701

Defendant's sentence for his convictions related to his role as a conspirator in an insider-trading scheme is affirmed, where: 1) the plain language of the background commentary to section 2B1.4 of the Sentencing Guidelines clearly indicates that defendant can be held responsible for the full extent of his co-conspirator's gains; 2) the district court did not err in concluding that that there was no need for an evidentiary hearing; 3) the district court complied with the applicable federal rules of criminal procedure regarding the presentence investigation report; 4) defendant was not entitled to the discovery he seeks; and 5) the sentence imposed was procedurally and substantively reasonable.
