United States Third Circuit

Pitts v. Delaware, 10-3388

In an action under 42 U.S.C. section 1983 and state law alleging false arrest, illegal seizure, malicious prosecution, and deprivation of equal protection under the law, the district court's FRCP Rule 50 judgment as matter of law, overturning both of the jury's verdicts in favor of plaintiff, is reversed where this case does not present one of those infrequent occasions in which the record evidence is so critically deficient that the jury's verdict should be overturned.
