United States Second Circuit
US v. Bussey, 13-1180
Defendant's conviction for violating the terms of supervised release imposed in connection with his earlier conviction for possession of a firearm by a convicted felon, is affirmed, where although defendant contends that the district court lacked jurisdiction because his original three-year term of federal supervision expired before the challenged judgment was entered and while he was incarcerated for a violation of state parole, defendant's challenge to jurisdiction fails because defendant's state incarceration was "in connection with" an underlying conviction, thereby tolling his federal term of supervised release.
