EMPIRE HEALTHCHOICE v. MCVEIGH, 03-9098

In a suit for reimbursement of insurance benefits, dismissal of the action for lack of subject matter jurisdiction is affirmed where plaintiff's contract claims arise under state law since the Federal Employees Health Benefits Act does not affirmatively authorize the creation of federal common law.
