United States First Circuit

Hurtado v. Lynch, 14-1751

In a petition for review of an order of the Board of Immigration Appeals (BIA) denying his motion to reconsider its earlier decision to dismiss his appeal of an Immigration Judge's (IJ) decision denying relief, the petition is denied where the new arguments raised in petitioner's motion to reconsider were previously available but not previously asserted, and the BIA did not abuse its discretion in denying his motion.
