United States Eleventh Circuit

MCDONALD v. S. FARM BUREAU LIFE INS. CO., 01-15648

Because the Federal Insurance Contributions Act (FICA) is silent as to whether an employee can sue his employer for proper payment of FICA taxes, and because there is no indication that FICA creates an implied private cause of action, appellant's claim was properly dismissed.
