Supreme Court of California

People v. Williams, S195187

Defendant's convictions for robbery arising from a scheme of purchasing gift cards with re-encoded payment cards are reversed and remanded, where the Court of Appeal erred in concluding that theft by false pretenses can satisfy the "felonious taking" requirement of robbery because the words "felonious taking" in the robbery definition were intended to refer only to theft committed by larceny and not to theft by false pretenses.
