Newland v. County of Los Angeles , 277638

Vacated and remanded. Plaintiff appealed from a judgment that found an employer not liable for an employee using a personal vehicle for his regular commute, even though at other times the employee used his personal vehicle for work. The appeals court agreed and directed the trial court to enter a new order granting the motion for judgment notwithstanding the verdict. The court reasoned that an employee must be driving a personal vehicle in the course and scope of employment at the time of the accident for an employer to be liable.
