In an action for writ of mandate, brought by a student who was suspended for his involvement in a sexual assault at a fraternity, the lower court ruling is affirmed in part and reversed in part where: 1) the university failed to provide petitioner fair notice of the allegations that resulted in suspension, or an adequate hearing on those allegations; and 2) as to violations of Student Conduct Code section 11.44C, encouragement, and 11.32, endangerment, the evidence does not support the Appeals Panel's findings as to either violation.
