In an insurance coverage dispute arising from an underlying construction defect litigation in which homeowners sued the developer-plaintiff and appellant for work performed by appellant's subcontractors, the trial court's order and judgment sustaining without leave to amend defendants' demurrer to the seventh and eighth causes of action of the original complaint filed by appellant, for regarding insurance coverage and the right to independent counsel pursuant to Civil Code section 2860, are affirmed where the claims are neither "ripe" nor "actual."
