In an appeal from a judgment of the trial court in an action for breach of contract arising from a denial of plaintiff's insurance claim arising from an FDA recall of bagged fresh spinach, judgment in favor of plaintiff is reversed where: 1) the court erred in defining the "Insured Event"; and 2) because its alternative theory lacks substantial evidentiary support.
