Superior Court decision declining to reinstate charges against defendant is reversed where the magistrate judge did not apply the proper law of causation as it was foreseeable that the deceased would end up in the water and was subject to the risk of harm from a moving propeller, and the defendant had the concomitant responsibility to those on board.
