Supreme Court, Appellate Division, First Department, New York.

IN RE: Anthony CORBISIERO, Petitioner-Appellant, v. Raymond KELLY, as Police Commissioner of the City of New York, etc., Respondent-Respondent.

Decided: February 16, 2006

BUCKLEY, P.J., SULLIVAN, WILLIAMS, GONZALEZ, CATTERSON, JJ. The Law Offices of John S. Chambers, New York (John S. Chambers of counsel), for appellant. Michael A. Cardozo, Corporation Counsel, New York (Marta Ross of counsel), for respondent.

Judgment, Supreme Court, New York County (Faviola A. Soto, J.), entered November 12, 2004, denying the petition seeking to annul respondent Police Commissioner's denial of an application for re-issuance of a carry business handgun license and dismissing this proceeding, unanimously affirmed, without costs.

The NYPD License Division took into consideration petitioner's seven arrests during the sixteen years prior to his application, and evidence that he handles large sums of money in the form of checks, not cash.   On this record, the determination was not arbitrary and capricious, and had a rational basis (Papaioannou v. Kelly, 14 A.D.3d 459, 788 N.Y.S.2d 378 [2005] ).

We have reviewed petitioner's remaining contentions and find them without merit.
