David S. STEPHENS v. Lawrence PICKETT, et al.
Writ application granted. See per curiam.
Granted. Genuine issues of material fact exist which preclude summary judgment. The district court did not err in denying defendant's motion for partial summary judgment.
The judgment of the court of appeal is reversed, and the judgment of the district court is reinstated. The case is remanded to the district court for further proceedings. The request for stay is denied as moot.

Hughes, J., dissents and would affirm the court of appeal.
