IN RE: Robert C. JENKINS, Jr.
Joint petition for consent discipline accepted. See per curiam.
ATTORNEY DISCIPLINARY PROCEEDING
Respondent charged an unreasonable fee and failed to render a periodic accounting to his client. This misconduct occurred during the same time period as the misconduct for which respondent was previously suspended. Prior to the filing of formal charges in this matter, respondent and the Office of Disciplinary Counsel (“ODC”) submitted a joint petition for consent discipline. Having reviewed the petition,
IT IS ORDERED that the Petition for Consent Discipline be accepted and that Robert C. Jenkins, Jr., Louisiana Bar Roll number 19256, be suspended from the practice of law for two years, with all but six months deferred. This suspension shall be retroactive to the effective date of the suspension imposed by this court in In re: Jenkins, 21-0293 (La. 4/7/21), 313 So. 3d 260 (“Jenkins I”).
IT IS FURTHER ORDERED that respondent's probation in Jenkins I shall be extended for one year, subject to the conditions set forth in the Petition for Consent Discipline. Any failure of respondent to comply with the conditions of probation, or any misconduct during the probationary period, may be grounds for making the deferred portion of the suspension executory, or imposing additional discipline, as appropriate.
IT IS FURTHER ORDERED that all costs and expenses in the matter are assessed against respondent in accordance with Supreme Court Rule XIX, § 10.1, with legal interest to commence thirty days from the date of finality of this court's judgment until paid.
