TED BREAUX
On Supervisory Writ to the Criminal District Court, Parish of Orleans
PER CURIAM
Granted. The ruling of the trial court denying the state's motion to exclude victim character evidence pursuant to La. C.E. art. 404(A)(2)(a) is reversed. We find the trial court abused its discretion in concluding that, based on the surveillance video depicting the shooting, defendant presented appreciable evidence of an overt act on the part of the decedent. The request for a stay is denied.
