Writ granted. The district court erred in finding McClenny, Mosely, & Associates (“MMA”) is a necessary party under La. Code Civ. P. art. 641. Complete relief can be accorded among the existing parties, and MMA's interest will not be prejudiced by the nonjoinder. See La. Civ. Code art. 2323(A) (requiring the trier of fact to allocate fault to all persons, “regardless of whether the person is a party to the action or a nonparty․”); see also Rayford v. Nat'l R.R. Passenger Corp., 2005-1273 (La. App. 4 Cir. 4/13/07), 962 So. 2d 5, 11, writ denied, 2007-1021 (La. 8/31/07), 962 So. 2d 439 (explaining a nonparty is not bound by proceedings to which it is not a party).
Accordingly, the judgment of the district court is reversed, and the exception of nonjoinder is denied. The case is remanded to the district court for further proceedings.
