STATE of Louisiana v. Benjamin NEWPORT
Writ application granted. See per curiam.
Writ granted. Under the totality of the circumstances, the record does not demonstrate that the photographic lineup conducted in this matter was unduly suggestive or that there was a substantial likelihood of misidentification, as required to suppress an identification. See, State v. Taylor, 09-2781 (La. 3/12/10), 29 So. 3d 481; Manson v. Brathwaite, 432 U.S. 98, 97 S.Ct. 2243, 53 L.Ed.2d 140 (1977). The trial court's ruling suppressing the identification is reversed. This matter is remanded to the trial court for further proceedings.
