MORGAN MCCANN THIBODEAUX v. LUKE JOSEPH THIBODEAUX
The statute provides that the trial court shall designate a domiciliary parent EXCEPT 1) when there is an implementation order or 2) for other good cause shown. This court ordered the trial court to comply with the statute, not designate a domiciliary parent with a “carve-out” for school matters, even if ostensibly for good cause. Piecemeal is anathema to the concept of domiciliary parent. If the parental duties are to be parceled out piecemeal, a full implementation order is required. The trial court has not complied with this court's order. While the motion is here denied, applicant may pursue relief through the standard channels.
