IN RE: Marc R. MICHAUD
On November 6, 2024, we suspended respondent from the practice of law for six months, fully deferred, subject to a two-year period of probation, based upon allegations that he mishandled his client trust account. In re: Michaud, 24-1180 (La. 11/6/24), 395 So. 3d 865. The terms of his probation included conditions that he properly maintain his trust account and reconcile the account on at least a quarterly basis.
Prior to the expiration of the probationary period, the Office of Disciplinary Counsel and respondent filed a joint motion seeking to extend respondent's probation for a period of six months. In support, they assert the extension is warranted to address issues uncovered during the prior trust account audits.
The requested extension is appropriate under the facts. Accordingly, we will extend respondent's probation for an additional six months, subject to all conditions of probation imposed by our November 6, 2024 order and by the December 2, 2024 probation agreement.
DECREE
Considering the Joint Motion to Extend Probation filed by respondent and the ODC, it is ordered that the six-month period of probation imposed upon respondent in In re: Michaud, 24-1180 (La. 11/6/24), 395 So. 3d 865, be extended for a period of six months. All conditions of probation imposed by our November 6, 2024 order and by the December 2, 2024 probation agreement shall remain in full force and effect during the extended probationary period. Any failure by respondent to comply with these conditions or any other misconduct during the probationary period may be grounds for revocation of probation and the imposition of the previously-deferred suspension or other discipline, as appropriate.
