CRICHTON, J., would grant and assigns reasons:
Pursuant to the provisions of Code of Civil Procedure article 966(H), I would grant the defendants’ writ application, order the parties to file written briefs, and allow an opportunity to make a written request for oral argument. It appears the plaintiff's cause of action is based upon a speculative theory of loss causation. Thus, in my view, this matter warrants further review by this Court to determine whether defendants are entitled to judgment as a matter of law.
