JILL PARDES v. ANDRIA PARDES (2023)

Petitioner Jill Pardes, as the executor of the Estate of Michael Pardes, seeks certiorari review of a March 13, 2023, order entered by a court-appointed special magistrate, Honorable Stanford Blake (Retired). Petitioner also seeks a writ prohibiting special magistrate Blake from further presiding over this matter. The challenged March 13, 2023, order denied Petitioner's emergency motion that claimed all post-judgment proceedings conducted by the special magistrate following this Court's issuance of the mandate for Pardes v. Pardes, 335 So. 3d 1241 (Fla. 3d DCA 2021), were beyond the scope of the trial court's November 8, 2016, appointment order.

This Court declines Petitioner's invitation to adjudicate, in the first instance, via extraordinary proceedings, the parameters of the trial court's appointment order, and whether special magistrate Blake is acting beyond his scope of authority. This Court, therefore, dismisses the instant Petition without prejudice to Petitioner seeking relief with the circuit court in the first instance, without expressing any opinion on the merits of Petitioner's claims.

Upon consideration of the parties’ Motions for Appellate Attorney's Fees and Costs, it is ordered that said Motions are hereby denied.
