NICHOLAS J. KOSTELNY and JULIANNE L. KOSTELNY, Appellants, v. BLUEWATER BAY RESORT, LLC, and EUROPCO MANAGMEMENT CO. OF AMERICA, LLC, Appellees.
The appellants ask us to review the trial court's order denying their Second Amended Motion for Relief from Judgment. That motion sought relief under Florida Rule of Civil Procedure 1.540(b)(2) and was filed on November 19, 2018. The day before that, the appellants notified the court that they were abandoning and withdrawing a previously filed amended motion for relief. A motion for relief from judgment under rule 1.540(b)(2) must be filed within a year of when the judgment was entered. The judgment was rendered on April 27, 2017. Accordingly, this appeal is DISMISSED for want of jurisdiction. See Fla. R. App. P. 9.130(a)(5) (allowing for a post-judgment appeal of an order “entered on an authorized and timely motion for relief from judgment” (emphasis supplied)).
