IN RE: Designation of Official Headquarters
BY ORDER OF THE COURT:
Section 35.051, Florida Statutes, authorizes a district court of appeal judge who permanently resides more than fifty miles from the appellate district's headquarters to have a county courthouse or other appropriate facility in his or her county of residence designated as his or her official headquarters for purposes of section 112.061, Florida Statutes, relating to travel expenses of public officers, employees, and authorized persons.
A district court judge for whom an official headquarters is designated in his or her county of residence under section 35.051, Florida Statutes, is eligible for subsistence at a rate to be established by the Chief Justice for each day or partial day that the judge is at the headquarters of his or her appellate district to conduct court business, as authorized by the chief judge of that district court of appeal. The statute also provides that a district court judge is eligible for reimbursement for travel expenses as provided in section 112.061(7) and (8), Florida Statutes, for travel between the judge's official headquarters and the headquarters of the appellate district to conduct court business.
Under his authority as administrative officer of the judicial branch and consistent with section 35.051, Florida Statutes, the Chief Justice may specify minimum operational requirements for the designated headquarters, limit the number of days for which subsistence and travel reimbursement may be provided, and prescribe activities that qualify as the conduct of court business. Payment of subsistence and reimbursement for travel expenses between the judge's official headquarters and the headquarters of his or her appellate district shall be made to the extent that appropriated funds are available, as determined by the Chief Justice.
For purposes of implementation of section 35.051, Florida Statutes, the Seventh Judicial Circuit, Putnam County Courthouse, Palatka, Florida, is hereby designated as the official headquarters for The Honorable Joseph Boatwright, II, effective January 1, 2023.
