Scott Alan KLINE, Appellant, v. Mark S. INCH, Secretary, Florida Department of Corrections, T. Kemp and S. Arnett, Appellees.
Appellant seeks review of an order denying his petition for writ of mandamus. Because the notice of appeal was not filed within 30 days of rendition of the order denying the mandamus petition, this appeal is dismissed as untimely. This disposition is without prejudice to Appellant's right to seek relief in the circuit court by filing a motion for relief pursuant to Florida Rule of Civil Procedure 1.540. See Brown v. State, 708 So. 2d 1041 (Fla. 1st DCA 1998).
Per Curiam.
B.L. Thomas, Osterhaus, and M.K. Thomas, JJ., concur.
