IT IS HEREBY ORDERED that the appellant's Notice of Voluntary Dismissal is recognized by the Court, and this appeal from the Circuit Court for Miami-Dade County, Florida, is hereby dismissed.
To the extent the appellant seeks an award of appellate attorney's fees, that motion is denied as no legally sufficient basis for such an award has been pled. To the extent the appellant seeks an award of costs, such costs are to be taxed by the lower tribunal on a motion filed in the lower tribunal and served on opposing counsel no later than forty-five (45) days from this Order. See Fla. R. App. P. 9.400(a).
