John BAILEY, Appellant/Petitioner(s), v. STATE of Florida, Appellee/Respondent(s).
To the extent that the petitioner seeks a copy of a judgment and sentence, the petition is transferred to the Sixth Judicial Circuit for Pinellas County. Although the petitioner asserts that the circuit court entered an order in county court traffic case A96K2BE, also numbered 522018TR007175000APC, on March 14, 2018, the Sixth Circuit's online docket reflects that a judgment and sentence issued in the county court case on March 13, 2018. This appears to be the judgment that the petitioner has identified in his petition. (Only the docket entry shows on the online docket; the document itself is not available.) Because the judgment and sentence were entered in the county court case, it is the circuit court's appellate division that is responsible for addressing the petitioner's petition. See State ex rel. Sentinel Star Co. v. Lambeth, 192 So. 2d 518, 523-24 (Fla. 4th DCA 1966).
To the extent that the petitioner seeks a writ of mandamus to vacate the March 13, 2018, judgment and sentence, the petition is denied.
The Sixth Judicial Circuit for Pinellas County is urged to expeditiously address the matter of the petitioner's request for a copy of the March 13, 2018, judgment and sentence.
The petitioner's motion for costs and fees is denied.
BY ORDER OF THE COURT:
