Petitioner's petition for belated appeal of his judgment and sentence following the revocation of his probation in case number 16-CF-17227 in accordance with his admission to violating his probation and his plea to new law violations in case number 17-CF-19145 is granted to the extent that the appeal shall proceed in case number 2D19-478. The order that petitioner seeks to appeal was rendered on January 25, 2019, and petitioner filed a timely notice of appeal from his judgment and sentences in case number 17-CF-19145 within 30 days of rendition of the January 25, 2019, order. That matter is pending in this court in case number 2D19-478. Because petitioner's judgment and sentence following the revocation of his probation in case number 16-CF-17227 was part of the same plea agreement under which his judgment and sentence in case number 17-CF-19145 was entered, this matter will proceed in case number 2D19-478 as an appeal of the judgment and sentence in case number 16-CF-17227 rendered on January 25, 2019.
Petitioner's objection to the State's response is denied.
