Estevan VILLANUEVA, Appellant(s)/Petitioner(s), v. CLERK OF COURT, etc., Appellee(s)/Respondent(s),
Estevan Villanueva seeks to belatedly appeal a November 18, 2018 trial court order denying Villanueva's motion to compel production of certain records. The record reflects that Villanueva filed a rehearing motion that was denied by the trial court on January 30, 2019. In its response to Villanueva's petition, the State concedes that Villanueva's February 6, 2019 notice of appeal seeking review of these orders was timely, and that appeal remains pending in this Court under case no. 3D19-722. We therefore deny, as moot, Villanueva's petition.
EMAS, C.J., and SCALES and LINDSEY, JJ., concur.
