AMY v. STATE (2019)

Petitioner's petition for writ of prohibition or in the alternative writ of certiorari is treated as a petition for writ of certiorari and is granted. The trial court's March 11, 2019, order summarily denying petitioner's motion for immunity from prosecution under section 776.032, Florida Statutes (2018), is quashed as a departure from the essential requirements of law because petitioner's motion stated a prima facie claim for immunity under section 776.032(4). See Jefferson v. State. 264 So. 3d 1019 (Fla. 2d DCA 2018).
