Upon consideration, the petition for writ of habeas corpus is hereby dismissed without prejudice to petitioner's right to seek relief pursuant to Fla. R. Crim. P. 3.800 or 3.850, as appropriate, in the Seventeenth Judicial Circuit where he was convicted. See Broom v. State, 907 So. 2d 1261 (Fla. 3d DCA 2005).
