Richard B. ROEDERER, Appellant(s)/Petitioner(s), v. Joanne J. ROEDERER, Appellee(s)/Respondent(s),
Upon consideration of the status report filed April 16, 2018, and the continued pendency of the appellant/former husband's motion for new trial in the underlying dissolution of marriage case, this appeal is dismissed without prejudice. The trial court has jurisdiction to grant or deny the former husband's pending motion for new trial, including jurisdiction to deny the motion as abandoned if the former husband does not promptly and diligently set it for hearing and disposition.
Appellant's motion for appellate attorney's fees is hereby denied.
SUAREZ, SALTER and LUCK, JJ., concur.
