Edwin A. Cruz VARGAS, Appellant/Petitioner(s), v. STATE of Florida, Appellee/Respondent(s).
In case 2D18–1308, the petitioner/appellant challenges the commissioner's report filed in his belated-appeal case, 2D17–4011. Such an order is not separately appealable. Case 2D18–1308 is therefore dismissed. The notice of appeal filed in case 2D18–1308 is hereby docketed in case 2D17–4011 as an objection to the commissioner's report.
Within 15 days of the date of this order, the petitioner may file in case 2D17–4011 a substantive objection to the commissioner's report. Once the 15 days have expired, this court will finally rule on his petition for belated appeal.
BY ORDER OF THE COURT:
VILLANTI, KHOUZAM, and BLACK, JJ., Concur.
