The notice of appeal and initial brief is treated as a petition for second-tier certiorari, and it is ordered that said petition is hereby denied. See Fla. R. App. P. 9.040(c) (“If a party seeks an improper remedy, the cause shall be treated as if the proper remedy had been sought ․”); Mena v. MBNA Am. Bank, N.A., 20 So. 3d 907 (Fla. 3d DCA 2009) (“Petitioner, Leo A. Mena, appeals the decision entered by the Circuit Court of the Eleventh Judicial Circuit, Appellate Division, for Miami–Dade County, affirming the decision of the County Court. On appeal, Mr. Mena requested that this Court reverse the County Court's decision. We treat this appeal as a second-tier Petition for Writ of Certiorari and deny the petition.”).
