Upon consideration of the appellee's response and statement of error filed February 7, 2011, the final summary judgment of foreclosure and the order denying motion for rehearing are reversed; this case is remanded for further proceedings including, but not limited to, amendments to the parties' pleadings and a re-filing of any motions by the parties thereafter.

Reversed and remanded.
