We affirm the trial court's decisions on the challenged evidentiary rulings and jury instructions, finding no abuse of discretion. We reverse, however, for the trial court to allow Appellant the proper amount of jail credit. The record reflects he spent 1,120 days in jail before his sentence, and he was only awarded 1,117 days. This was error. § 921.161, Fla. Stat. (“[T]he court imposing a sentence shall allow a defendant credit for all of the time she or he spent in the county jail before sentence.”). On remand, the trial court shall amend the judgment and sentence to reflect 1,120 days of jail credit.
AFFIRMED in part, REVERSED and REMANDED in part.
