M.A. GRONDIN, Trustee, Appellant, v. VILLA BISCAYA JARDINES, PHASE II, CONDOMINIUM ASSOCIATION, INC., Appellee.
We find no error in a trial court holding that condominium maintenance charges levied pursuant to condominium documents recorded in 1974 take priority over a second mortgage recorded in 1980 pursuant to Section 718.116(6) of the Florida Statutes as it existed in 1980.1
Therefore, the order of priority established by the trial court is affirmed.
Affirmed.
FOOTNOTES
1. The condominium documents are silent as to the rights of a second mortgage holder.
