HAMMOND et al. v. STANLEY et al.
The sole question involved on this appeal is whether section 2924 1/212 of the Civil Code, as added by St. 1933, p. 1674, § 8, applies to trust deeds and notes which were executed prior to its effective date. If the section is applicable to such paper, the judgment should be affirmed; if it does not apply to such paper, the judgment should be reversed. This court has taken the position that the Code section does not apply to such paper which was executed prior to its effective date, and the reasons are set forth in the recent case of Bankers Life Co. v. Canterbury et al. (Cal. App.) 50 P.(2d) 83.
Judgment reversed.
