US v. Johnson, 11-10290

In a prosecution for making a false statement with respect to information required to be kept by a federally licensed firearms dealer, conviction is affirmed, where: 1) the district court correctly instructed the jury on the elements of the offense, since a) 18 USC section 924(a)(1)(A) does not require the government to prove that the falsehood related to the lawfulness of the sale, and b) the district court properly decided as a matter of law that ATF Form 4473 was required to be kept by licensed firearm dealers; and 2) the district court provided adequate instructions on witness credibility.
