Pendleton v. QuikTrip Corp., 08-2363

In a dispute involving employment benefits, district court's grant of summary judgment for defendant is affirmed where: 1) the court did not err in finding defendant's termination was not made for the purpose of interfering with his ERISA rights, as defendant failed to show he was entitled to any severance or stock benefits under the plain language of the severance plan; and 2) the court properly denied defendant's motion for attorney's fees.
