United States Eighth Circuit
US v. Carter, 05-3391, 06-1365
Defendants' convictions on drug and firearms charges are affirmed over claims of error regarding: 1) a denial of one defendant's motion to sever the trial; 2) denial of his request to represent himself; 3) denial of another defendant's Batson challenge; and 4) a finding that sufficient evidence supported his conviction of conspiracy to distribute crack cocaine. One defendant's sentence is vacated where the district court plainly erred in excluding the statutory mandatory sentence on a particular count.
