United States Eighth Circuit

Surya v. Gonzales, 05-2493

A petition for review of a denial of petitioner's application for asylum, withholding of removal, and relief under the Convention Against Torture is denied where the court of appeals lacks jurisdiction to review an IJ's determination that the asylum petition was not timely, but even if it was timely, his petition failed because he did not demonstrate that he had a well-founded fear of future persecution.
