US v. Smith, 05-2124, 05-2126

Defendant's conviction for drug-related offenses is affirmed over his claims of error regarding: 1) jury instruction; 2) sufficiency of the evidence; and 3) ineffective assistance of counsel. However, his sentence is remanded for resentencing pursuant to the government's claim that the district court erred by not imposing an obstruction of justice enhancement.
