In the Matter of: City of Chicago, 07-2608

On a motion requesting clarification after an order requiring a civil plaintiff to pay filing fees and costs after determination that his motions to proceed in forma pauperis had been fraudulent, the order is modified to provide that it may be lifted immediately on full payment, but otherwise reaffirmed where: 1) the order did not impose a new monetary sanction; 2) the order did not violate due process; and 3) there would be no risk of prejudice to the defendants from indefinite delay.
